De acordo com a corporação, as prisões foram determinadas pelo próprio Supremo, a pedido da Procuradoria-Geral da República (PGR).
Os nomes dos acusados não foram divulgados pela PF.
Os mandados de prisão foram expedidos pelo próprio Alexandre de Moraes, e a audiência de custódia dos acusados será realizada às 17h de hoje pelo juiz instrutor do gabinete do ministro.
Em nota, o gabinete informou que a prisão dos acusados Raul Fonseca de Oliveira e Oliveirino Júnior foi determinada pelo procurador-geral da República, Paulo Gonet, após a Secretaria de Segurança da Corte detectar ameaças contra familiares do ministro por meio do monitoramento de rotina. Além disso, foram enviadas mensagens ao ministro com os dizeres “comunismo” e “antipatriotismo”.
Para a Procuradoria, os acusados tentam impedir a atuação de Moraes, que é relator da investigação sobre os atos golpistas de 8 de janeiro. No entendimento de Gonet, há indícios da prática do crime de abolição violenta do Estado Democrático de Direito. O crime é caracterizado pelo emprego de violência para impedir ou restringir o funcionamento dos poderes constitucionais.
“A gravidade das ameaças veiculadas, sua natureza violenta e os indícios de que há monitoramento da rotina das vítimas evidenciam, ainda, o perigo concreto de que a permanência dos investigados em liberdade põe em risco a garantia da ordem pública. A medida é, assim, proporcional, ante o risco concreto à integridade física e emocional das vítimas”, justificou o gabinete de Moraes.
