A decisão da Corte favorece os governadores, que previam perda de aproximadamente R$ 12 bilhões se as ações de contribuintes que defendiam a cobrança do tributo a partir de 2023 fossem aceitas.
Durante o julgamento, por 6 votos a 5, a maioria dos ministros do STF entendeu que a regulamentação não criou novo tributo, que existe desde 2015. Dessa forma, não cabe a aplicação do princípio anual da anterioridade e incide apenas a carência de 90 dias para início da cobrança.
Em fevereiro deste ano, o Supremo manteve a validade das mudanças nas regras que tratam da cobrança do Difal/ICMS.
